Legal Question in Personal Injury in California

i was injured at a friends house, doing work for myself that I was given permission from the homeowner to do. I needed medical attention and went to the emergency room. I have no way to pay the bill and my injury is on my hand resulting in permanent loss of one of my fingers. Is there homeowners insurance liable for bills and compensation for pain and suffering.

The facts you provide are WAY to vague to really answer your question with any accuracy, but it is highly unlikely that their insurance will pay. Unless the homeowner is somehow liable to you for your injuries, such as by negligence or some hazardous condition of their property that they knew of and failed to repair or warn you about, then the insurance company is not liable either. Insurance companies only pay the insured to protect the insured from the insured's liabilities that are covered by the policy. So if the insured isn't liable to you, there is no insurance.

Your facts are not sufficient to address the key question of whether the homeowner has any liability for your injury. If so, or even if maybe so, then there may be coverage under the liability portion of the policy. This is often called Coverage E.

There is also often, but not always, an additional coverage in homeowners policies called Coverage F for medical payments. This is most commonly limited to $1,000. in total, but can be endorsed to a higher total at the policy holder's election. This would cover the costs of medical care for injuries sustained on the covered property up to the limit (again, probably $1,000.), and subject to certain exclusions. This coverage does not depend upon liability determinations, but only covers medical expenses and would not cover pain and suffering.

I suggest you contact an attorney who knows something about insurance to explore your circumstances in greater detail as the severity of your injury suggests that it would be a very good idea to take a detailed look at liability and coverage details. You may contact my office at (415) 665-0400 or any other competent insurance attorney of your choosing. I wish you the best with your recovery from your unfortunate injuries.
