Legal Question in Personal Injury in California

Injured inside Department Store

Lat year I was injured inside a department store at the hands of on one of its emplyees. I have been through months of PT and treatment by an orthopedist. I got an attorney right after the accident and she has filed a law suit against the store. I am due for a deposition in a few weeks. To my best understanding my attorney has not as of yet come up with or asked for any specific damages. My question is this: Is it possible to file a law suit and get as far as having a deposition (discovery) and not come up with what you will be asking for? I would also like to know what to expect at the deposition. Thank You very much

Not only is it possible, it's actually quite common. Sometimes attorneys delay making a demand for strategic reasons. Other times they want to see how the evidence develops before making a demand. Depositions are one of the ways in which the evidence comes out before trial, so it often makes sense to wait until the parties have all heard the testimony before making a settlement demand.

Your lawyer will be able to tell you what to expect at your deposition. Each depo is different, and the unique facts of your case will determine what the other lawyers are likely to ask.
