injury liability

I rent space in a trailer park for 4 years and recently fell down on a broken sidewalk only 10 feet from my home. Landlord walks through property daily but always avoids repairing anything. lower back damage, semi-serious. Can I sue?

The park owner must maintain the park in safe and habitable condition. I suspect there are other problems relating to lack of proper maintenance of the park. As such, I recommend that you talk to a lawyer experienced in this area.

The owner's liability for your injuries will depend on the nature, size and depth of the "break" in the concrete. Are we talking about a missing piece of slab? A crack with one edge raised that caught your toe? How deep was the depression that you stepped into or how great the difference between the lower and the raised portion of slab?

These are important facts. If you do not have photos of the defect that caused the fall, you should photograph it immediately. If it is repaired tomorrow, you will have no evidence. Place some object next to the defect so its depth can be seen.

The other important issue is what kind of injuries you sustained. Please specify. Did you do damage to your lumbar discs? Did you have an MRI or CAT Scan? How much work have you lost? Do you have health insurance to cover your bills?
