Legal Question in Personal Injury in California
the insurance company denied the claim
I got a car accident last year. At that time, my car parked in a parking lot. I was sitting inside. My car is still. And my car was hit by a car when that car backed off to leave.
At that time, the person agrees she hit my car and called her insurance company mentioning it's her who hit my car and had some damages there.
My car was sent to a body shop by myself and identified it as $500 damages.
I went to my doctor because of stomache and other uncomfortableness after this. I also took sick leave due to this for days. That insurance company was notified.
But just several days ago this insurance company said they would deny my claim because the don't think there are car damages found by a hired inspector.
They also said I can go to California Claim Court to suit them.
I am not sure what's the progress and what materials I should prepare. I was told by my own insurance agent that I do not need to hire a lawyer for this. Please advise.

I agree with your insurance company. Your best avenue for recovery may be through the Small Claims court system. See http://www.courtinfo.ca.gov/selfhelp/smallclaims/# for assistance.

Thank you for your posting.
You are able to sue, in small claims court, or through an attorney, for anything that the insurance company does not agree to pay, such as body damage to your car, and your stomach ache, if directly related to your accident.
