Legal Question in Personal Injury in California

No insurance,no vehicle registration, no driver's license & loaned car to friend

I have no driver's license because of an outstanding fine I haven't paid, my car is not registered in my name and still has Oregon plates (car was transferred to me Sept. 2002) and no car insurance. My boyfriend borrowed my car and totaled it and killed himself in the accident. Will I be responsible for anything or get in any trouble because of this?

I'm sorry to hear about your loss.

Unless the accident was caused by some mechanical problem with the car which you knew (or should have known) about, I don't see how you can get into trouble over this tragedy. Even if the accident was caused by such a defect, you would likely be responsible only if you had an opportunity to warn your boyfriend about it and failed to do so.

When I say "responsible", I mean in terms of civil liability. From what you have written I don't see any basis to accuse you of a crime.

All of this analysis is based on the limited facts you have provided. My answer might be different if I had a more complete understanding of what happened.

Not having a license is no problem--you weren't driving. If your boyfriend caused any property damage in the accident, the police may trace the plates back to the prior registered owner in Oregon but if that guy kept any records, it could come back to you. Without any insurance, there is a possibility you could get billed but it seems like a long-shot for now. Were they towing or storage bills? There's no "trouble" to get into except civilly if someone finds you and wants something to be paid that is related to the accident. I got a better idea!!! Next time, get a license, transfer title to you, get insurance and watch out for those boyfriends.

I would need a few more facts before I providing a preliminary opinion in your case. Most personal injury attorneys will be glad to provide a telephone consultation at no cost.

Your best bet is to call a good P.I. attorney near you. If you can't find a friend/relative to refer you to one, try the yellow pages or the attorney referral service operated by the county bar association.

I was astonished and taken back by reading the comments provided by other counsel. I believe you may be subject to great problems. You are the owner, no insurance. If driver negligent, you may be defendant as allowing negligent driver, no insurance and it may directly hit you. My recommendation is that you get matters in order, seek counsel of attorney to discuss all aspects of this and wait for the mountain to crumble, hopefully not on top of you.
