under insured motorist

We were struck by an under insured motorist. property damage 10400 minor injury to passenger.Can passenger sue in small claims court. Can I also sue in small claims for part of the property damage.

Thanks for your question. Yes, your passenger may sue the other driver and you in small claims, but is limited to $5,000.00. If you sue in small claims, you will also be capped at $5K for everything. If you have underinsured motorist coverage on your insurance, that may cover your full property damage and personal injury claim, if any. An attorney will help put pressure on your insurer to set up the UM claim and get you paid. Good luck.
