Not insured,.rear ended

What are my rights, if uninsured,not at fault and was rear ended?

You have rights to recover your out of pocket expenses. "Out of pocket expenses" include, medical expenses, repair of your vehicle, loss of use of the vehicle (rental reimbursement), lost income and etcetera. You have no right under California Law (know in the business as Prop. 213) to compensation for "pain and suffering".
