Lawyer fees

our car was rear ended 2 weeks ago, we suferred minor injury and our car was declared as total loss. My husband decided to hire an attorney. My question is; what if the other party can't pay; who is responsible to pay the fees for the atty that was hired by my husband. Please advise,thank you

If the car accident occurred in California and your husband signed a contingency fee, attorney fees come out of the gross settlement. The attorney should explain all of this to your husband and you.

If your husband hired the lawyer on an hourly basis then he has to pay the bills, regardless of the outcome. If he hired the lawyer on a contingency basis then her fee will come out of the settlement or judgment. How other costs are to be paid will depend upon the terms of the lawyer's contract.
