Lawyer used profanity

I called my Lawyer the day before a deposition because I was very ill. I had been out of work for a few days and didnt feel like the end of my flu symptoms were even close ie.aches-fever-stomach-nose issues... He yelled at me and said ''I just knew you would pull this'' and ''No, you better get your ass to that deposition'' and he said''you better reschedule this'' and as he started to hang up on me he said the one and only ''F'' word. I am still in shock and don't know what I should do. Is this behavior common and acceptable or should I file a complaint? He is a real bully, has on several occations made me cry, settled 1 case for almost nothing, didnt even pay the dr.bill. He took the 1st offer and thats it?

From the sounds of things, you should definitely look into replacing your attorney at the very least based on your complaints about his/her "professionalism" and/or "results". However, absent any clear misconduct in his/her work on your behalf, your complaint may not "hold water" under the circumstances, even though it is VERY unprofessional to subject a client to such verbal abuse. This isn't a Law Guru question, this is a Dr. Laura question. However, since you posted your question on Law Guru, your question does deserve an honest answer. Suppose your mechanic spoke with you the same way this attorney did? Would you continue to use his services? Being an attorney does not excuse one from abusive behavior towards others. Find another attorney to evaluate your case. This guy sounds like poison and you should get out!

The issue is relationship. Your lawyer represents you. If you don't like him, don't believe he is trying to act in your best interest, fire him and get another. In a personal injury case the new attorney will have to resolve the issue of fair compensation for the old lawyer after the case is resolved.
