Legal Question in Personal Injury in California

Liability

What does Liability insurance cover?? My insurance company says that they can't contact the other insurance company to collect the money to fix my car in a accident. Now, is this true or do I have to contact the insurance of the person whom hit me??.

Thanks in Adv.

Re: Liability

Liability coverage pays for any damages to the other party if you are at fault in an accident. Liability coverage does not cover damage done to your vehicle. In order to get your car fixed you either have to have property damage coverage on your own insurance or you need to file a claim with the at fault driver's insurance company. It sounds like you do not have property damage coverage so you need to contact the at fault driver and request the name and number of the his insurance company's representative. I hope this helps. If you have any further questions about repairing your vehicle or seeking the proper medical attention for any injuries you may have sustained, please feel free to contact my office toll free at 877-546-9918 for a free consultation.

Sincerely,

Re: Liability

If your have your own coverage, you may make a claim against your own company (but a deductible may apply.) Against the other company, you are entitled to recover in full..and don't forget about making a claim for reasonable rental and loss of use as well.

Re: Liability

Concerning your liability insurance coverage on an auto policy, that covers bodily injury and property damage that you or someone else driving your case causes to another person. It is a coverage that defends you and protects you in case your at fault and cause bodily injury and property damage to someone else. A typical bodily injury claim includes medical bills, wage loss and pain and suffering. Typical property damage claims would be car repairs, car rental, towing and storage, personal property damage and other fixed objects.

Your own insurance company will not represent you against the insurance company for the responsible driver. Your own company does not go on the "offense" on your behalf. It is your responsibility to make contact with the other company and either handle the claim yourself or hire an attorney to help you. Of course, if you have collision coverage for your car with your own policy, you can get your car repairs paid for in that fashion.

If you are represented by an attorney, you should discuss these issues in more detail with your own attorney. If you are not represented, please call my office at 714-963-5123 so I can give you a more specific and personal evaluation by telephone. If you call and I am not in, please leave a day and evening number so I can get back to you.

Sincerely,
