Legal Question in Personal Injury in California

I live in a rented apartment. There has been water leaks from the roof molds. I had informed the maintenance and no action was taken. Today a big portion of the mold collapse on the bed. We are lucky enough not sleeping on the bed at that time. I have a 2yr old son and he generally sleeps on that bed too. This is a clear case of negligence which could have led to some serious consequence. Can I sue my leasing office for this negligence?

You can't sue for negligence because you didn't suffer any meaningful damages. You need to call the county or city health department and have the unit condemned. Then the landlord will be foreced to deal with the problem. If they don't, you will be entitled to move out and sue them for significant relocation damages.

Of course you would also call your renter's insurance carrier.
