Legal Question in Personal Injury in California

Lying about insurance claim

A car backed up into the front of my car in a parking lot. The driver tried to pay me off on the spot for the damages, but we didn't accept. We filed a claim with their insurance, and they agreed to pay $2000 for damages. Then, a month after the accident the driver lied and said we rear-ended him. His insurance company now says we are liable. What are my legal rights and what course of action should I take?

I must fight this to the end based on principle.

Re: Lying about insurance claim

Unfortunetly you only have one option. If the person is lying you will have to prove that in Court. Either small claims or limited civil.

If you have not reported this claim to your insurance company you should do so immediately. Your insurance company will defend against his claim.
