My math teacher told me i should kill myself can i sue him?

he said i'm being honest with you, i own a gun i can let you borrow it. also for how much?

That's an outrageous thing for a teacher (or anyone) to say to his student. You should report him to the principal. You might have a viable claim for intentional infliction of emotional distress, but I'm not sure such a claim would be worth bringing. In part, that would depend upon how much distress the comments have caused you. With more facts I might see more (or less) basis for a lawsuit.

What a strange situation. Normally, I wouldn't believe you, but given the fact that I've had so much exposure to crackpot teachers, anything's possible.

Were there witnesses? Does he have any history of such conduct that you know of? These are important questions because without the above, even filing a complaint to the principal might not be taken very seriously.

You need to inform your parents who need to bring the matter to the principal's attention and maybe the School Board. Maybe it was a very bad joke but still inappropriate. Your claim for intentional infliction of emotional distress would not be worth much unless as a result you were so mentally disturbed that you require psychological treatment. You might have hard time proving it unless there were witnesses or the teacher has told other students similar things and can get other students to testify as to that.....
