med pay sent to attorney not treating doctor

I am a chiropractor in CA treating a patient who has med pay with state farm. I billed her auto insurance and they sent the checks (over 5K) to her attorney- who won't return phone calls and stated he would ''look for the checks in his office!'' claims adjustor stated this was customary for patients having an attorney- its never happened to me before- any suggestions on how to get paid without waiting till the case is settled?

Write a certified letter giving him seven days to remit checks to you, or you will report him to the State Bar.

Also, you have the potential crime of conversion. Notify him that you will file criminal charges, as well as notifying the State Bar.

Tell the lawyer you will contact the State Bar unless he either delivers the funds or sends a letter to the Ins Co stating it can and should cancel payment on the drafts and reissue payment to you.
