Legal Question in Personal Injury in California
medical mileage reimbursement on an auto injury claim
I filed a claim for mileage reimbursement for trips to and from the doctor for an auto accident claim. The adjuster told me that the going rate for medical mileage reimbursement was .15 per mile. This rate seems rather low since the going rate today for irs is between .37-.40. Is the rate lower for medical mileage reimbursement or am I just being taken advantage of?

No, the rate is not lower for accidents and yes, they are taking advantage. It should be the same as what you can deduct for business mileage on a tax return. But the amounts for milage aren't usually that high and not worth fighting over too much.
Re: medical mileage reimbursement on an auto injury claim
Usually, when one is taught to take an multiple choice exam, they're told to never choose the "always..." answer because it is always wrong. However, when dealing directly with an insurance company one can usually check the "always" box because insurance companies "always" try to take advantage of those who work directly with them.
To get to the other part of your question, I believe that the going rate is 37 cents per mile.
Good luck

Look I hate to be the cynic, but why are you dealing with an adjuster without legal representation. Of course they are going to offer you less than you are entitled too. Why do you think there are personal injury lawyers? It's because we do this for a living and we know how to maximize a recovery whether it be during pre-litigation or settlement or through litigation. Good luck.
