Legal Question in Personal Injury in California

A nurse came into our house to administer home care to my wife. He wore a mask. After several hours, he removed the mask and we noticed that he had a sore on his lip. Now, 10 days later, my daughter has developed a sore, which is in the exact same place. I feel that he must have touched something and she contracted it. Can I sue the nurse or registry for which he works.
