Legal Question in Personal Injury in California

My Mom has a fragmented 4th vertebrae

About two weeks ago in the rain, my mom went to a supermarket. Since the supermarket had no rug at the front door, she slipped because it was really pouring out. Well, she went to the emergency room the next day because she had a concussion. Finally we talked to the manager about the incident and hired a lawyer, who was a friend. She the went to a bone specialist, and found out the reason her neck hurt so much was because it had chiped. That was a week ago, the lawyer has not talked to us about anything. I was wondering how much we could get to cover her medical expenses. We are not greedy, just that she is hurting really bad and is afraid to continue to go to the doctors. Going only when she is hurting to badly, because we have no health insurance. Please respond we are pretty desperate about her situation, because she cannot work. She is also self-employed, which leaves us in dire straits for money. My friends in law school says that this is a tort case, in which we could require the market to place out carpeting at the front door at all this, and post out the yellow "Wet" signs, since neither were ever present.

Your mother is seriously injured and should be treating with a specialist. Your attorney should have provided her treating doctors with a lien so that she does not have to pay them until the case is settled. Since your attorney is a family friend I realize that it is hard to fire him, but it is better to find a new attorney than to let your mother's injuries go untreated because he does not know what he is doing. She should go to her doctor and ask for him to recommend a specialist such as an Orthopedic Surgeon. Since the supermarket failed to warn against a hazardous situation she has cause to make a claim against them for medical bills, lost wages and pain and suffering. However, the first thing that needs to be done is to make sure your mother is receiving the treatment that she needs. Failure to treat an injury such as hers could affect the rest of her life and that should not be compromised because she cannot afford to go to the Doctor. This is why you hire an attorney. They are suppose to handle everything for you so that you can focus on treatment of the injury and getting better. You should be talking to the attonrey you hired and not seeking advice on the internet. If your attorney is not communicating with you, you may need to hire another attorney. Contact your attorney with the information about the extent of you mother's injury, the name of the doctor that provided this infomration, and a signed release of medical information form, for you attonrey. If that does not get results then you should seriously consider hiring another attorney.
