Legal Question in Personal Injury in California

I need help getting my money back.

I helped a friend out in college to build up her credit by opening up a joint credit card. We had agreed that she would close the card as soon as she got another card. I have not made a single charge on the card. Well 10 years later, I discovered that the card was never closed and that there was a balance on the card of over $15,000. As a primary on the card, I took over payments on the card. I need help and guidance on how I should proceed to sue her to get my money back. I have made contact with her and she has no intention of paying me or the credit card company. I dont want my credit affected. Please Help!

What you are going to want to do is to sue your friend and get a judgment against her. Then you are going to take that to the credit card company and ask them to remove you from the debtor list. In the event they refuse, which they will, you will want to sue them for a declaratory judgment, which should absolve you as a debtor and relieve you from your responsibility to pay the debt. You may be able to move for an injunction against the credit company from reporting to the three credit companys until the matter is resolved.

The bad news is that you are going to have to retain an attorney to get you out of this mess. However, a good attorney should be able to get a lot of your costs back out of the individual from the suit.
