Legal Question in Personal Injury in California
This morning I was having coffee with friend, I was parked under a meter. I had put change in the meter and I was sitting right in front of my car. When I looked I saw that there was only minute left (meter had not expired yet) as I got up to go put more change in the meter, (I was right in front of it about to place the quarter) the parking enforcer came out of know where literally pushed (several witness who saw him push me) me aside with his shoulder and told me it was to late for me to put money in it. He had not even wrote ticket yet, and I got into verbal argument saying that the meter still had no expired and I was about to place money in there,all he said was "I can do whatever I want" He wrote me the ticket, when I placed money in the meter afterwards the meter wrote failed. I told him to stop that I was call the police, but he left. I called the police the officer wrote a battery report on the parking enforcer and the officer wrote that the meter was failed the whole time in the report, but i had told him excatly what had happened.. I called his supervisor to complain and they could careless what happend. All I want to know is do I have case against the city or how could make sure that there is action taken against this parking enforcer. He had no right to touch me. I have several witness who saw him do that. What can I do?

You do have a case in theory, however your damages do not amount to a hill of beans in this world.
Your remedy is with the District Attorney. Since the police officer did the right thing, his report of the battery will go to the D.A.. Hopefully, the cop gave you a slip with the police report number on it. Here is what you can do to see that this rogue meter enforcer is stopped before he hurts someone: Write a letter to the District Attorney's Office, attention of the Misdemeanor Charging Deputy. Explain what happened and BE SURE you put the police report number on the top of the letter in bold letters, and mention the date of the incident. Enclose written statements of the witnesses along with your letter,and urge the D.A. to charge the parking enforcer with battery, and pledge that you will cooperate and appear in court to testify. You will be doing everyone in your city a favor taking this loose cannon out of circulation.
