Legal Question in Personal Injury in California
Motorcycle Accident - Should I retain an Attorney?
I was involved in a motorcycle collision w/ a car. The driver of the car made a left turn from a side street in front of me and as a result, a collision occured where I was thrown from my motorcycle. The accident was witnessed by a police office who was following behind me. He cited the driver for an illegal left turn into oncoming traffic. I had just purchased the motorcyle 2 months prior and had not had a chance to get liability insurance on it yet. The officer accpeted my insurance for my car and wrote that policy number on the report so he did not cite me for no insurance. I also suffered serious road rash and bruises all over my body as a result. My question is what kind of compensation can I expect and should I retain an attorny for this case since the driver of the car was clearly at fault?

Your first big problem is not having liability coverage on your motorcycle. You will now be limited in what type of damages you can collect from the responsible driver. You may have covered the situation up with the police so as to avoid a ticket, but when the responsible driver's insurance company requests specific insurance information on your motorcycle that is where the problem will arise.
You will be able to collect medical bills and wage loss but it may be difficult hiring an attorney because you will not be able to collect pain and suffering or any money for disability. Depending upon the complexity of your damages, you may not need an attorney and may be able to submit documentation to the other party yourself.
If you are in the Orange County area, I would be glad to provide a free consultation to you.

It is worth hiring a lawyer. Especially when most attorneys would take the case on a contingency basis. An experienced attorney knows how to get what you deserve. Please call me directly at (619) 222-3504.

You do need to get an attorney to negotiate with the driver's insurance company, in order to obtain a fair settlement. If you did lack insurance, that has nothing to do with whose fault the accident is.
Re: Motorcycle Accident - Should I retain an Attorney?
You have posed a rather difficult question. The difficulty lies in your insurance coverage. Under normal circumstances you would be able to recover for all losses occassioned by the negligence of the other driver, including the repair costs of your vehicle, damage to your clothing, loss of earnings, medical expenses, and an extra sum to compnsate you for your pain and suffering. However, if you have no liability insurance you may not be able to recover the last item. A lawyer will be absolutely necessary to help you first determine if you have insurance coverage through your auto policy and secondly to properly evaluate the claim and push it thru to resolution with the responsible party's carrier.
Whether or not you decide to hire an attorney, you should keep a diary of any significant pain, injury and recovery as well as take lots of pictures, dating them over time.
