Legal Question in Personal Injury in California

Negligence

The city allowed the phone and cable companies to place their cables under the sidewalk. Therefore, the city sidewalk had been removed partially for these lines to be

placed. They then filled this depression with gravel and tarred a full sheet of plywood for to it. The wood is chipped and a corner has rotted, the wood has been there at least 2 years, and the city is aware of it. The worst part is that one side of the plywood sits at least 1 inch above the level of the sidewalk, thus allowing anyone to trip if not seen.. Plus, after a heave couple days of rain, that wood was so slick and when walking my dog at night, I tripped, slipped, and hit my head on the concrete......abrasions, bruising, and swelling. I went to ER, etc. and later had a petite pal which I have not had over a year. Should the city/phone/cable companies be liable for my lost wage, bills, and injuries. Worse yet, I am on probation working w/ juveniles.......may lose my job if determined that I am unable to be working w/ them.. I am scarred, worriedk, and on the brink of finanical ruin anyway. I really just need advise on seriousness of this. I have lots of photos of face, the sidewalk, & risk (2 yrs) City claims aware just unable to get cable co. fix

Re: Negligence

It seems like you may have a good case. Given your employment situation, there could be lost wages, pain and suffering, medical bills, etc.

With this said however, it seems like you may know a little too much about the area where you fell. My point is that if there was some prior awareness of this condition which made you fall, the defense will raise contributory negligence as its defense. This is why it is essential that you carefully choose your attorney. For a free consultation, you can either call 1.877.505.INJURY,or email me at [email protected].

In any event, be sure to submit a claim with the city within 6 months of the accident.
