Legal Question in Personal Injury in California

My neighbor's kids scrached my car with their scooters and I caught them doing it. The estimate came out almost coupld thousand dollars and my neighbor does not want to be responsible for it. What should I do? They're very trensient people who move from one place to another and my insurance company and I have a very limited information about them. And I'm not sure how far my insurance company are willing to pursue them if I have my car fixed using my insurance.

You could file a small claims lawsuit against them, and then try yourself or hire an attorney to collect on the judgment.

1st see if they have homeowner's insurance. If they do, this would be covered under their policy. If they don't you can make a claim under your own auto policy and go after the parents for your deductible or let your insurance company try and subrogate against them.

Why did you buy insurance in the first place? So you would have peace of mind and protection for something like this. I would forget about it and let your insurance handle it because then you don't become the bad guy. You can say to your neighbor hey I asked for help and since you couldn't or wouldn�t I had to turn it over to my insurance company. That is a lot less hassle than suing them in small claims court which you could do if you wanted, but don't you have better things to spend your time on?
