Non Car Accident Injury
I recently had knee surgery done on my right knee. It is healing well and I would have, within a few weeks, been released for work again.
Last Thursday, February 3, '05, a gentleman made an left hand U-turn, against his red light, right into my path. In order not to hit him I had to slam on my brakes and now the knee is where it was a month ago. Instead of possibly going back to work in 2 weeks, it might be another 4-6.
I took down his lic number, discription of the vehicle and the fact that it had his work name stenciled on the back window. Unfortunately, the police can do nothing because I didn't hit him, hence no accident.
My question is, can I sue him for the lost time I will have to remain out of work because of his negligence? I'm not out for a windfall, just compensation for the additional time out of work that I will not be paid for.

Yes. The fact remains that the driver drove his vehicle in a negligent manner and caused you injury. He is liable the same as if there were an actual collision. Yes, but you may have a hard time proving your case if the only evidence you have is your own testimony.
