My van got hit in a parking lot by a motorhome damaging my right rear light and bumper. he left the scene. i found him by luck and he gave me his insurance card. To date, he has not responded to his ins. company's calls. what are my rights?

If you have collision get your insurance company to repair you vehicle. They will pursue the other guy's insurance and upon payment return your deductible to you.
Or
Get your body shop estimates (2) and send them to his carrier with a note to pay the claim or you will sue the deadbeat in small claims court providing notice to his insurance company. You have no requirement to wait.

You can either try to contact the other driver's insurance company directly and pursue your claim in that fashion. Or, if the other insurance company will not deal with you until they talk to the other driver, you would have to contact the other driver yourself and threaten some kind of legal action - for example, Small Claims Court- so that he will cooperate with his insurance company. If after a certain period of time nothing happens you would have to then sue the other driver probably in Small Claims Court to force the issue.

Since this party has not responded you will have to sue him and do it ASAP. Failure to cooperate with ones insurance company are grounds to deny coverage to that person. If the amount of damages are under $5000.00, then sue in small claims court. If over and/or there are personal injury problems, then see an attorney ASAP.
