Legal Question in Personal Injury in California

Hi in November 2007 my boyfriend was doing some work for our landlord, who was paying him cash. He unloaded 30 90 pound bags of concrete and when he came home that night he complained of pain in his side. I told him to go to the doctor and he would not because he has no insurance. Now he still has this problem and it is getting worse. He cannot really work because of it, and I have been doing all the work to support the two of us. ( I suspect he has a hernia) What I want to know is the statue of limitations over is it to late to file a suit against my landlords homewowners insurance or to do anything so that he can be compensated for his injury?

There is a one year limit (with exceptions ) for Work Comp. claims and your land lord may be covered under Work comp in his insurance policy. Otherwise, there is a two year statute of limitations for personal injury.
