If you've been to prison, you're stuck with the conviction.

You could have appealed your conviction, but you have to file a notice of appeal within 60 days of sentencing, and it's obviously too late for that.

People who are placed on probation can apply for a dismissal under Penal Code 1203.4, which is sometimes called an expungement, but it doesn't seal or destroy your record.

However, since you went to prison, you aren't eligible for that.

I disagree with Mr. Marshall. I do not see any restriction against an expungement of any conviction because of any prison time. I can help you with that. I would charge about $1500.00. Call me at (916) 721-3324.
