Legal Question in Personal Injury in California
Parking lot 1 Way Accident
I was driving in a public parking lot and I ignored the painted arrow on the ground and I drove into the lane. I stopped for approximately 1 min to unload some packages. While I was unloading, a car began to back out of his parking spot. The distance between my car and his car was maybe a 2-3 meters. I then beeped and my passenger got out of the car and yelled stop 5-6 times but the man didnt pay attention. He ultimately hit my front wheel well costing less than 500 of damage. The driver himself confessed to not checking his rearview mirror. His insurance adjuster is claiming it is my fault because I was pointed in the wrong direction. Who is at fault?

Re: Parking lot 1 Way Accident
It seems to me that the other driver is more at fault. Your car could have been in exactly the same spot facing the right way and he still would have hit you, so the fact that you had gone the wrong way doesn't seem to be the cause of the accident.

You may be partially responsible. However, the other party has some liability. Go to small claims court and try to collect this way.
