Legal Question in Personal Injury in California

personal belongings

If I left some of my personal belongings at my girlfriends house, with the intent of returning to them. Then we broke up and she threw it all out. Is there anything I can do?

You can sue her for conversion, to recover the value of the property. You can also report her to the police, though I doubt they would get involved.

You can look at Civil Code Sction 1951.3, where the landlord or property owner must give notice to you of her intent to sell your property, since she believes it was abandoned. Read the rules to see if she has complied, and if not, you may be able to sue her for your losses. I can do this, but I more expensive than you can believe. Joe Marman

Well, there are some missing facts here. How long was the stuff left there? Did she give you notice to remove it? Your "intent of returning" would be a pale excuse if she gave you several warnings to remove it and you did not.

Secondly, what is the value you are talking about? If it is very small, don't drag yourself down by making it a Federal issue. You can sue her in Small Claims Court for up to $7500 for the lost property, but my thought is not to bother if she gave you notice to remove it and you put it off til she cleared it out on her own.
