Legal Question in Personal Injury in California

Personal Injury at a childs party business

My child was at a birthday party at a children's party facility that has blow up jumpers. He fell out against wall that had screws coming out. He went to ER had stitches.

If i take this to small claims court. What is the laws on compensation? What can you ask for?

The proprietor is responsible, as Mr. Roth points out.

Not only can you recover medical bills, but also extra for pain and suffering, as well as the emotional distress on your part.

You should consult a personal injury attorney ASAP. He/she will explain the laws on compensation, and will handle your case for a percentage (contingent fee) of the settlement. It is very rare that you will get as much of a settlement handling your own case, as you would by letting a qualified attorney represent you.

You probably should consult a personal injury lawyer on this as the proprietor is probably liable. Your child is entitled to medical expenses and pain and suffering for the injury and recover to the injury and probably some permanent scarring. A lawyer will do this on contingency, meaning any fee will come only from the recovery. If you were there at the time, you too have a case for negligent infliction of emotional distress.

You can call me if you want, but I'll be gone until Monday.
