Legal Question in Personal Injury in California

Personal Injury

Good day, my cousin was in a fender bender, in which he was not at fault but it was not witnessed by anybody. The policemen arrived and did not do too good of a job of collecting the info on the accident. After everything was said and done, the lady who hit him has changed the tune and started screaming that it was his fault. I have heard of the services were professionals are reconstructing the mechanics of the accident by looking at the photos of the damage. However, I did not find anything advertised on the net. The only a few companies that I found were more of the commercial type of the companies which charged an arm and the leg for the services. I've heard that it is a service which costs hundreds, not thousands. Can someone help me to find such services in the Los Angeles Area?

Thank you.

Re: Personal Injury

There are accident reconstructionists, but you won't find anyone who can help you determine fault with no witnesses and a bad police report. If you do, they will cost thousands because an accident reconstruction takes a lot of time. If this is a fender bender and there are no injuries, let his insurance deal with it. If he does not have insurance, go to small claims court.

Re: Personal Injury

I do not know anything about such services, but in general an accident reconstructionist can merely determine the speed and angle of impact, not who is at fault. How could anyone determine who ran a red light unless they were there to see the signal lights. The force of impact in a rear end collision is the difference between the speeds of the two vehicles, but that does not tell you what speed either vehicle was going. It is possible for such an expert to state that looking at everything said by one or both parties that certain alleged facts are inconsistent with the other facts, but that often will not show who is at fault [normally, both parties have inconsistencies in their versions of what happened]. If it s a fender bender is it worthwhile to hire such as expert even if they could determine anything? Is there insurance coverage so the carriers will determine who they think is at fault? His insurance rates will only go up if he is found to be more than 50% at fault.
