Legal Question in Personal Injury in California

When a personal injury lawsuit is filed against a County and that county has a cap on the liability insurance is there a way of putting a lein on them untill the full settlement amout is reached. I am running into an issue with the amout of lost wages, medical bills, and lifetime health care, my lawyer seems to think I'll be able to survive on 3.5mil when my lost wages alone would total out 7mil roughly....anyone know what I can do, I just want to get this over with and know that my future will be secure, so when Im gone my daughter will be taken care of.

It sounds as if you do not trust your lawyer. There is no way to really know what your losses actually would be. If you want to discuss this further, please call me at your earliest convenience.

Yes, get a judgment for the entire amount. Your recovery is not limited to the insurance limits, it is limited by whatever Judgment you get. If you get a Judgment that exceeds the 3.5 million, you will get that amount from the carrier, and the county will owe the rest. You can then take steps to collect the remainder.

It sounds to me like your attorney is just trying to get you to settle the case without litigating so he or she can get a quick payday.

I do personal injury cases all over the State of California. You may check out my website at www.thepersoanlinjury.com , and then call me for a free consultation at 800-816-1529 x. 1. In California you have the right to terminate your attorney at any time!
