Personal Injury Settlement - Medical Payout

Hi

I have settled a p.i. case, signed a disbursement agmt for their fee and medical. I asked for a break-down of medical that he paid out, they never gave it to me. I finally contacted the dr. and found out he had not paid it (6 wks aft. sttlmnt) and settled for 2K less than what they took out. When i told him what dr. said, he quickly got me off the phone. Now he says he's waiting to hear back from a provider for their settlement.

I am confused, shouldn't this have been done b4 settlement and b4 i signed a certain amount for med payout? Isn't that the usual order?

Basic ethics requires that an attorney both negotiate lien settlements and report those to the client as part of the process leading to settlement approval. You're supposed to know before you accept who's going to get paid what.

If you've already signed off on the settlement check and can't get the information you need on disbursement, you have a complaint to make with the State Bar.
