Personal Injury - Slip and fall

I was staying at a beach resort in

California, where they drive you to

your cottage and carry your bags.

They show you your room, warn you

about the danger associated with the

fireplace, and there is even a waring

on the in-room menu concerning the

dangers associated with drinking

alcohol.

During the stay, I slightly pulled back

the shower curtain, turned on the

shower, I did notice that there

seemed to be some lines in the

shower, which seemed to be for

traction. Then I stepped into the

shower at the back end and my left

foot slipped up into the air and I

came down hard and hurt my hip

and back. I was in extreme pain, so

it took a while for me to get up.

After I got out of the shower, I

noticed that there was a rubber

shower mat that had been rolled up

in a corner. The bathtub floor

seemed to have some soapy residue.

It seemed that when they cleaned

the bathtub, they (1) did not rise the

surface completely, and (2) they

forgot to lay down the mat.

My question is, Do I have a cause of

action? Will I be able to sue and win?

Slip and fall cases can be extremely difficult to win, because of the possible, or probable, contributing negligence of the injured.

Tough case. The first defense will be prove it.

1. That the floor was left soapy wet before you checked in.

2. That the shower mat was not in plain sight.

3. That they were negligent in some way that caused or contributed to your fall or injury.

Some lawyer might take the case as you describe, but it is a long shot at best.

In what city were you injured? Had you been drinking? Did you complain to the owner/management? Did you give statement? Do you have a copy of the statement?
