Legal Question in Personal Injury in California

A victim in car accident wants me to settle for an amount greater than my policy limits. If I have no assets, no job and no way to pay a lump-sum or monthly restitution, what is the worst that can happen if I tell the victims cousel ''I just can't help''?

They can proceed and get a judgment against you and then proceed to attache property or income to collect. It may force you into bankruptcy.

If you are insured and they are demanding an amount greater than your insurance policy it does not mean that they are entitled to an amount greater, just that they are claiming they are. You should turn this matter over to your insurance company. If they do not respond to the claims made against you, you may have a claim for bad faith against your insurance company. Your insurance company is required, in good faith, to represent you and present you with the peace of mind you purchased when acquiring your policy.
