If I the plaintiff accepted a 998 offer can I cancel the acceptance and still go to trial if I have signed the release?

Short answer: no. If you are the Plaintiff, and you accepted a 998 offer and signed a Release, then that's it, the case is over. There would have to be a truly extraordinary and unusual excuse to cancel the deal. Simply changing your mind or having regrets is not enough. It would have to be something like you were clinically insane at the time--something on that level.

Very unlikely, but there may be reasons (including some which aren't as far-fetched as the ones Mr. Stone mentioned) why you could cancel. I would need to know more about the case and about the offer before I could say for sure.
