Legal Question in Personal Injury in California

Police report or no Police report

Should I make a police report if there was no bodily injury or damage to vehicles to perties involved? What should I do if they make a claim of bodily injury and damage to vehicles when there was none? Will my insurance go up and pay for their claims even if I feel it is fraudulent?

If the damage to either vehicle was over $750, file an SR-1 with DMV within 10 days. Otherwise, if you get sued, send the lawsuit to your ins. co.

Making a police report does not change the answers to any of your questions. Take photos of your vehicle from all angles and of the other vehicle if you can. Beyond that you can only play it "as it lays."
