Legal Question in Personal Injury in California
Postman dog attack
The postman sprayed my dog with pepper spray in my yard, chained behind an enclosed 3.5foot brick wall. There is a 5ft distance to the mail box which is outside the yard. I called and complained about the spraying. My mail stopped for 1wk. I received a letter stating he was attacked. I received a 2nd letter from the Workers Comp HR dept 2mo later stating he is asking for $985.40 for pain & suffering and inconvenience. That is all it said(no documentation of his injuries). I called and he is claiming the dog was loose and he sprained his ankle because my dog attacked him. He is lying and I refuse to pay this. Do I need a lawyer to fight this? I'm not being sued(yet). It is''in house'', he is using the HR dept and not a lawyer.
