Legal Question in Personal Injury in California
Pregnant Woman Enroll in Massage School ?
Hello. I currently serve as an instructor as well as the director of a vocational massage therapist training program at a private college in San Jose, CA. A young woman who is pregnant would like to enroll as a student in the program. I'm advising strongly against that idea, mainly due to the rigors and strenuous physical demands which the 720 hour program requires of its' students. If a miscarriage resulted from her student activities at the school, or she experienced a miscarriage outside of and completely unrelated to the school, I feel in both cases the school ( and possibly myself !! ) would be wide open to some serious liability damages. A recent case which I'm aware of happened at the Acupressure Institute six years ago when a pregnant student miscarried while attending the school and sued them for damages. Most medical advice counsels against pregnant women performing heavy physical labor, and the massage modalities we teach at the school would certainly qualify in that regard. Also, receiving the various forms of massage therapy taught in the program are also medically contraindicated.
After she's had her baby : no problem. So, can you cite any cases/lawsuits where a miscarriage occured and a school was sued ? Merci !

This question should be directed to your school's liability insurance carrier.

If I were you, I would be concerned about the lawsuit if she is rejected because of pregnancy.
