Previous Back Surgery

The vehicle I was driving was rear-ended in 6/98. The damage to my car was minimal but the damage to his car was around $5,000.00. I had back surgery for scoliosis in 1989 and this accident has severely affected my ability to do normal activities. I am currently receiving chiropractic care and have been informed that I have soft tissue damage and it is degenerative. It has not dislodged the Harrington rods in my back, however, the pain is severe. What kind of restitution can I expect?

The kind of restitution you can expect depends on

many factors. There are too many to list. However,

since you do have preexisting injuries it will be

harder to recover damages from the other driver's

insurance company. In these situations it is wise

to seek legal counsel since attorney's can better

evaluate and convince the insurance adjuster that

the accident did in fact agrivate your previous

condition and that you are entitled to compensation.
