Legal Question in Personal Injury in California
I am currently in the process of suing my local school district for an injury that happened to my daughter on the playground at school. my daughter was playing on the playground when she fell and broke her leg,she was sent to the nurse, and the nurse sent her back to class.the problem is that the school district did not call me when this took place, i was unaware of the injury until i picked my daughter up from school. i would like to know what i would be suing the school district for negligence or for not calling me when this incident took place?

If you want to sue the school district, there are several points that you should consider. First why do you think the school is responsible for your daughter's injury. Was it negligent supervision or was there some defect on the property or with some equipment that caused her injury. Next I will submit that the conduct of the nurse was negligent and appalling, but how did it effect her injury. Did if make it worse or was it just the emotional trauma that she caused. That would be negligent infliction of emotional distress that the least.
In order for you to a have a case first you must file a claim with the school district. You have six months to do that. Then after they reject the claim or fail for 45 days to act on it in which case it is deemed rejected by operation of the law then you have 6 months to file your suit.
