I bit into a cookie purchased at trader joes and there was a bolt in it. I cracked a tooth and have seen my dr. i have gotton the run around with trader joes, the company that made the cookie(which trader joe tell me it is their fault) and the inusrance company. what are my rights? the insurance company wants the bolt with the cookie product baked into it and the other cookies out of the bag I purchased.

You can do well on a case like this, but you need professional assistance to maximize your value. If you brought me the case, I'd obtain and review your medical records, possibly making further referrals to be sure that you received all the care you're entitled to. Then I would present a demand together with the evidence of their liability (without giving the evidence itself directly to them!) and negotiate a fair settlement. Trader Joe may be right that they had nothing to do with the manufacture of the cookie. The producer may be the real defendant. You tell the ins. co. for the producer of the cookies that they can send someone to your home to look & photo the bolt but can't have it. Or you can send them a photo. Gather up all your medical bills and records and photos of your injury and send it to them with a settlement demand--not too high!!! If nothing happens, you can to to Small claims court for up to $7,500.00.

If you send the insurance company any bolts or cookies you'll never see them again. See an attorney or take trader Joes to small claims court. Preferably see an attorney. Watch out for legal time limits.
