Prop 213 Re: Uninsured Mexican driver

If a mexican uninsured driver was in the U.S. for 7 days and is involved in an accident that is not his/her fault, would Prop 213 exclude him from recovering general damages? Case law/sources?

Yes it does. see Calif Civil Code section 3333.4
