Legal Question in Personal Injury in California

property damage

6mos ago i was in a auto accident the police report states that the guy who broadsided me while he ran a red light and had also been drinking was at fault.he was also cited for running a red light.his insurance company (allstate) said that his initial statement was that he entered the light when it was yellow .there for he's not at fault. he also hit and ran and was caught 40 miles away on a military base by mps.i have a witness but he was not mentioned on the report.i did not have any insurance.how do i get them to pay my car was totaled

It is your word against his. However, you have three points in your favor. One, the police report. Two, the fact that he was drunk. Three, the fact that he fled the scene. The insurance company is just trying to save some money and stall with the hope that you will settle for half.
