Legal Question in Personal Injury in California

Question regarding an accident

I was hit from behind in an accident one day after my brother bought a car. I was driving the car. My brother had another car and was insured in that one. Since I was hit a day after we bought the car he still did not have insurance for the new car. I had a neck whiplash and I was taken to the hospital. My lawyer filed a complaint and was able to obtain 9 thousand dollars for hospital damages. Now he says that because I was not insured, I am not entitled to anything, except the hospital bills. Is this true or is he trying to scam me? Does not the law allow you ten days to get insurance after you buy the car in California?

Re: Question regarding an accident

It can be 10 days or even up to 30 days. If your brother bought an additional vehicle, then generally that vehicle is covered under your brother's policy as long as the new car is added on within 30 days of purchase. If you or brother reported the purchase of a new car after the accident within even 10 days, the new car should be covered. you have to get a copy of your brother's policy and read it carefully as to coverage for add-on or new vehicles. This should be your attorney's job.
