Legal Question in Personal Injury in California

My name is Rachel. My son was bitten by my landlord's dog this morning. He has a couple of puncture wounds and one laceration that needed two stitches all on his lower left leg. This is an aggressive dog and has gone after my son before. They have another dog that has bitten my son's best friend, as well. Is this something I could or should pursue? I'm looking for advice at this point. Thank you.

Rachel,

This is something you should pursue. California has a law that creates strict liability for dog bites. As long as your son was lawfully on the premises where he was bitten it is a clear case of liability unless he provoked the dog.

Our firm has handled many dog bite cases all over the state of California and would be happy to assist you. Please feel free to visit our website at www.lawkuhn.com or call (949) 218-6600 x 101 or toll free at (877) 238-3086.

Mr.Kuhn is right, you should pursue a case to get your medical bills covered and get compensation for your son's stress and inconvenience. If you are in northern California, I could help you here. (916) 721-3324.

Rachel,

I hope your son is recovering well from this unfortunate accident. In terms of your legal rights, you should pursue a case on behalf of your son as he should be compensated for the injuries which he has suffered. In California, there is strict liability for dog bite cases. You should find out if your landlord has premises liability insurance and you should have your son evaluated by a plastic surgeon if he develops a permanent scar as a result of this incident.

I have handled numerous dog bite cases and I would be happy to give you a free consultation in regards to your son's case. You can call me toll free at (888) LAW-1177.

Hi Rachel. This is Barry J. Simon, ESQ. I agree with most of the other lawyers' advice. Please describe exactly how the dog bite occurred and the type of dog involved and forward any photos of your son's injuries (and your son's age) and any medical and animal control reports. Are there witnesses and were the police called? Is your neighbor sorry or being a "jerk" about it?

You can reach me at [email protected] or call 1-877-733-4393 so I can evaluate your son's potential case against your landlord.

In addition to what my colleagues all recommend, I would suggest that you might call animal control (county or city), and have them deal with the animals. It doesn't appear that they should be roaming free on an apartment premises where there are children around.
