Rear ended parking lot

In a shopping mall parking lot while backing up I hit a car passing behind me. When I started moving the other car was several approx. 8 car length down the isle. I was more the 2/3 of the way out of my space and the other driver never stopped, but sped up to pass before I finished exiting. The driver was a 17 yr old inexperienced driver and the car was very old and beat up. There was some minimal damage to the door, but will be hard to fix since the rest of the car is pretty trashed. Does the other driver have some resposibility in this for not stopping? I did not give out my insurance info and would like to settle this on our own. Is there a limit to how much they can recover considering the condition of the car before the accident? Am I soley at fault?

Welcome to CA where no one stops for anyone anymore. It's a contest about liability. They'd say you should have waited. You'd say they were so far away. Send them a letter asking for half because of your possible comparative fault, and see what you can get. Obviously, if it's on his parents' insurance, you might send his parents a letter as well.
