Legal Question in Personal Injury in California

I was rear ended two years ago.

I never sued and then let it go.However,I have had numerous medical issues and might have permanent nerve damage.Because I have depression,I tend to back away from conflict,but I screwed myself.Is there anything I can do about it now??The insurance company two years ago,even tried to say it was 51% my fault!Complete bull!Obviously to get me to not sue. Im fed up and still suffering from it!! Help!!!

If it is more than two years ago since the accident occured the statute of limitations has expired. If the defendant, the person who hit you has been absent from the state, the SOL tolls for the period of his absence. So you still might have some time.

What was the actual date of the accident? The statute of limitations is two years. There are a few exceptions.
