Legal Question in Personal Injury in California

I was rear-ended on the freeway. The other driver did not own the vehicle, when I asked for insurance information, the insured was a woman. I reported the accident to my insurance co. When when their ins. co. called me, I found out that the woman who owned the vehicle (the insured) said that she was driving when the accident occurred. It was a man that hit me. There was no woman in the vehicle! Her insurance is taking financial responsibility, but why did she lie? Am going to chiro in the a.m. Now what?

It really is not clear why people say or do some things but at least the other driver is insure and your claim should be covered. You are entitled to reimbursement of all of your out of pocket damages plus pain & suffering based upon the severity of your injuries, any permenant,residual, long term problems with no deduction for any comparitive negligence as you were not responsible for the accident. Whether or not the woman is lying is not the controlling issue for you. The larger issue is whether or not her carrier is on board to pay your claim. In any event, this is why accident victims retain counsel.
