Legal Question in Personal Injury in California
Rear-ended on the Freeway
My wife was in a car accident while driving on the freeway. The CHP was called and a report was taken. She isn't sure if the first vehicle behind her hit her before or after the second vehicle behind her. She was in a hurry and left the scene after the police took her statement but before she could get any info related to insurance from the other two drivers. She is concerned that the driver of the first vehicle did not have insurance (I guess he could not speak English and has an old, beat up looking truck) and that the driver of the second vehicle hit the first vehicle after the first one hit my wife. In addition to the damaged car, my wife has some back pain. Any advice on how to proceed with this?
Thank you in advance.

Re: Rear-ended on the Freeway
First get the traffic collision report to determine if the other drivers did or didn't have insurance. Report the accident to your own insurance company. See to your wife's injuries, and keep records of her expenses. If you have medical payment coverage, submit her medical bills to your insurer under that coverage. If one or both of the other drivers were uninsured, report your wife's injuries to your insurer under your uninsured motorist coverage. If one or both of the other driver's were insured, get the name and address of their agents and report the accident to them.
