Legal Question in Personal Injury in California

I was rear-ended over a year ago while parked in a school zone waiting for my child.

There was a police officer in a motor cycle that witnessed the accident.

She, the crasher suburban rambo speed driver Mom was cited at fault.

Question: what would be the expected pain and suffering dollar demand/amount that I would expect to recieve.

I have all my medical receipts, expenses, travel time, and loss of work?

The total medical is about $8,000.00 and expense recorded.

We're thinking more towards ging to court?

Please advise.

It all depends on how aggressive your attorney will be, what the defendant is willing to pay, and what you are willing to accept. There's also a question as to the severity of the impact, whether you were belted at the time, whether you had to miss work, whether you could not do things you did before the accident, lingering effects, the extent of your physical therapy, and several other factors. Remember, there is a two-year statute of limitation for filing a lawsuit for personal injury.

If you have achieved a complete recovery, without any residuals, the value would be somewhere between $30,000 to $50,000. If you have other problems, such as possible need for surgery, future treatment, etc. it could be much higher.
